Just two years ago, life was much different.

"She was going to school for physical therapy. She used to work at Gottschalks. She used to be the girl who put the displays in the windows and everything," Carlos said.

At the age of 28, Mikesha fell into a diabetic coma.

His wife facing death, Carlos quit his job; put his studies as a doctoral candidate on hold and became a full-time in-home care provider for the woman he'd married nine years earlier.

Fresno, CA--Representatives and supporters of the more than 12,000 families who rely on In-Home Support Services to care for elderly or disabled loved ones will hold a vigil on Tuesday at noon out side of the Fresno Board of Supervisors meeting as the clock ticks down to the July 1st deadline for dangerous home care cuts to go into effect. Clients and family members fear that the lower wages will force workers to find new jobs forcing their loved ones into institutions.

Carlos Martinez whose 29-year old wife is recovering from a diabetic coma, said in court filings "I am very concerned that I will be unable to replace my wife's IHSS providers if they quit. I do not know how I would provide the care that she needs in order to remain at home if I could not find IHSS providers for all of my wife's authorized hours. I am very worried about the possibility that I might have to put my wife in some kind of institutional care if I could not replace her IHSS providers."

In Sacramento County, unlike Fresno, officials chose to work with the union to offset losses in local revenue with federal stimulus funds to assure no loss of pay for home care workers. SEIU UHW and Sacramento County reached an agreement in May to sustain current wages and healthcare benefits .

Last week SEIU filed for a emergency injunction to stop the cuts from going into effect on July 1st. The lawsuit was brought on behalf of individual consumers and SEIU, and argues that the planned cuts put seniors and people with disabilities at risk and violate the American with Disabilities Act, the Rehabilitation Act, and federal Medicaid Law.

Just ask Healthcare Illinois Member Organizer Sandra Lockette, who knows that every vote counts. She spent a lot of time in northwest Indiana last fall, helping Barack Obama eke out a narrow victory in the historically Republican-leaning state.

In Fresno, and armed with her water bottles and walk sheet, Sandra was ready for day 5 of our union's GOTV drive.

"I had to come to Fresno, I just had to. This election is so important to the members here. Every day, I've walked someone out to their mail box as they cast their vote for SEIU UHW. Last November showed me that you can't take anything for granted. Every vote does make a difference."

And Those Walk Sheets? They Didn't Appear by Magic

Valerie Anderson Webb can attest to that.

"There were just a handful of us back in February," Valerie said. "And we had to start building a union, building the records from the ground up."

She and her coworkers went out day after day on house visits, telling members about SEIU UHW and building their contact lists. It was an effort to both educate the members and conduct an accurate census. "They had been ignored so long - many of them didn't even know they were in a union. It was a big job"

But, little by little, day in and day out, the number of contacts grew.

"Ben Tracy and Stacey Peterson were just great!" Valerie marveled. "Especially when we got more help and we started to reach more and more members. They just kept digging in, updating the lists, and helping us have what we needed to keep going"

Ben was a lead organizer from Healthcare Illinois & Indiana and has been in California since January. "The records were a mess. It soon became clear that the old leaders had ignored nearly 7,000 of their members; 3,000 only received occasional mailers, and 4,000 low-hour home care workers were largely ignored."

No one even knew how members should be listed. No one knew who spoke languages other than English because that information wasn't recorded. In fact, the Spanish-language list and much of the Hmong list weren't completed until last week, and the data and organizing teams are still working on Lao, Cambodian, Russian and four other language groups.

"The contrast was stunning" Ben said. "We visited 8,000 workers before the GOTV blitz and the former leaders had ignored 7,000 of them for years. How can you get someone to vote for you after ignoring them so long?"

The data team kept growing the lists and worked with SEIU technical specialists to work the information into easily usable formats. That work would become ever more important as the massive GOTV kick off approached. Nearly 1,000 SEIU activists poured into Fresno County, and each soon had a walk sheet with compact, easy-to-understand routes to canvass. Then, each night, after volunteers returned with their collected reports, the walk lists were pared down, tightened.

The first days of the massive, county-wide push became a targeted precision exercise to reach remaining voters. But it's turning into much more as the first week winds down. Now, SEIU UHW members are going back to those who already voted to ask them to get active in fighting the draconian budget cuts politicians are trying to impose.

And what does Valerie think about it all? "This past week has been awesome. It's like one of your babies that you watch grow and come of age. I arrived here February 2 and then there were just a few of us and no records to work with. Then there were 30 in March. And now this - hundreds and hundreds. It's just amazing."

Valerie will remain in Fresno for another two weeks. After all, there are still more votes to be cast. More members to be contacted. More work to be done and a union to rebuild.

Valerie Anderson Webb is a Home care worker from Spokane Washington. She has been in Fresno County since February 2nd.

Neither Rain Nor Sleet, Nor...

At 2 a.m. Friday morning, even Mother Nature discovered that the crack SEIU UHW data team was unstoppable. The graveyard shift had been working for several hours to prepare the walk sheets for the next day. Then thunder and lightning struck in the dead of early morning, knocking out power at their worksite and the surrounding neighborhood.

It was a roller coaster ride for Member Organizer Rene Valdez. "When it first happened, everything looked so bleak - like there was no hope."

Frantic calls immediately went out for laptops with AirCards (devices that can provide wireless web access when there are no nearby hot spots or cable connections available) and cell phones with light options that could shine a dim but usable glow on laptop keyboards. A hand cranked, wind-up flashlight was even called into service.

Finally, by 9 a.m. and under the most difficult of circumstances, the data team had gotten the job done. One hundred Spanish language and 200 English turf routes were delivered to Fresno canvassers who were counting on the information to do their work. Shortly afterward, updated lists were sent to SEIU UHW walkers in distant Firebaugh and Mendota.

Many of the new routes were specifically for home care workers who had already voted. These members would be the first recruited for phone calls and letter writing programs to legislators and county commissioners to fight the budget cuts - and to sign up workers to attend a Tuesday June 9 rally prior to the next Fresno County Board of Supervisors meeting.

"It was just this big sense of accomplishment," Rene said. "Everyone just pulled together to get the job done. Everyone felt good and it sure was a relief."

The data team would have like to provide some good pictures of the all night effort, but there was this wee problem with the lights...

LA Members from ULTCW: Here Before, During and After the Blitz

A small, but powerful strike force of Los Angeles County Member Organizers - members of SEIU ULTCW, has been in Fresno County since February fighting for SEIU UHW home care workers. Educating members, attending Fresno County Board of Supervisor meetings with them, and anchoring this week's GOTV effort, the LA team has made a lasting difference for home care members long ignored by prior UHW leaders.

"We came to activate home care workers to take hold of their union, SEIU UHW," said Mary Gillon, a home care worker from San Bernardino. "False promises were circulated, and we came to educate workers with the truth. It makes sense that they also hear about other issues, like budget cuts, from other members."

LA County caregiver Michelle Reed has been knocking on doors for over four months, talking to Fresno County workers. "They know how serious this is. One member told me that he might gamble a chicken or two, but he WILL NOT gamble the farm."

The LA Strike Force members will be here for another two weeks helping Fresno workers move to the next phase of rebuilding their union.

"They do not want to give up their union." Michelle Reed added. "And this is only the half of it. We have galvanized leaders who want to take on Schwarzenegger and proposed budget cuts. We have brought back home care workers to UHW in more ways than one. It's really been rewarding."

Numbers Tell the Story in Fresno: Home Care Workers Vote to Stay with Their Union

The largest GOTV drive in Home Care election history achieved its goal effective 5 p.m. this evening, Friday, June 5. More than 5,000 Fresno County caregivers - exceeding half of all eligible voters - have pledged support to defend their union, SEIU UHW, against a decertification threat.

"I could see it coming all week," said Member Organizer Shanisha Robinson of Local 6434. "Nine out of every ten members I talked to voted to keep SEIU UHW. And that's the same message I heard from everybody on my team."

SEIU Executive Vice President and Director of Organizing Tom Woodruff, in Fresno to support the campaign, lauded the effort. "This election and these results harken back to the great struggles of the 30s when labor firmly established itself as a force for positive change in America. This is the kind of effort we need to use in our fights to win healthcare for all, achieve card check recognition for the unorganized, and in our broader fight to win economic justice for everyone in the country."

SEIU UHW Trustee Dave Regan praised the enormous effort put forth but the nearly 1,000 SEIU members and activists who came to Fresno. "I made one promise when we kicked off this drive on Monday. I said that we would win this election to protect Fresno County Home Care workers. We have delivered on that promise. The election is virtually over tonight."

"I wanted to vote SEIU UHW and NUHW took away my ballot!"

Ofelia Gonzalez's home is just southeast of the center of Fresno. As a home care worker, she takes care of three of her grandchildren. But the peace and quiet of her home was disrupted a few days ago when some NUHW organizers interrupted her routine. Not long after the mail arrived, they arrived at her door.

"NUHW showed up and told me I needed to sign with them, but I didn't want to. I told them I was voting SEIU UHW," she recounted to SEIU UHW's Oscar Delgado. "My ballot had already arrived and they told me I needed to open it right then. I did it and the NUHW people took away the one paper [ballot sheet] I really needed to vote with. They even took away the SEIU UHW magnet I had put up on my front door."

Oscar suggested that Ofelia might want to call the police. He also made sure to tell her how to order a new ballot.

Ofelia has decided not to file a police report, but she has no doubts about what she is going to do. "I know what they did was wrong. I'm going to call and ask for another ballot, fill it out, and vote for SEIU UHW. I want SEIU because they can help us with all the problems we're facing in the state. We need to stick together to protect ourselves."

Firebaugh Burns Bright for SEIU UHW

Home care workers are saying "YES" to SEIU UHW all over the town of Firebaugh. Cline Street, Clark Street, Cardella, Borbon, and Althea Avenue members reached by SEIU member Margarita Garcia yesterday said, "I'm sticking with SEIU UHW." Five for five, and that was just before noon--and just one SEIU volunteer.

Some Firebaugh caregivers were like Ebelia Huerta, from a little lane of houses at the western edge of Fresno County. Ebelia filled out the ballot on the spot at her kitchen table.

"Yo apoyo la unión SEIU UHW porque siempre he estado con la misma unión, y pienso que la unión hace la fuerza. Además, es la que nos apoya a conseguir los beneficios que tenemos y sé que está negociando para que no hayan recortes en nuestros salarios. Y es por esto que apoyo a SEIU UHW," dijo Ebelia.

English: "I support SEIU UHW because I have always been with the same union," she said. "I believe that unity is strength. This is the union that helped us get the benefits we have, and I know we're negotiating now so that our wages don't get cut. That's why I support SEIU UHW."

Then Ebelia walked out to the main road to place her ballot in the rural mail drop.

Margarita was also joined by another SEIU Southern California home care volunteer for the day, Rosalba Murillo. By the end of the day, after making a second and third trip through the area, the two planned to confirm that 41 more Fresno home care workers on their route had voted for SEIU UHW.

Another team was door knocking in Mendota yesterday afternoon. There are 39 home care workers in the town, and the volunteers had a plan to reach out to every one.

On the Road in Riverdale with SEIU Members

Glenda Faatoafe, a home care worker from SEIU 775 NW in Washington State said yesterday that, "our work in Fresno is a united front because it's all about every worker, not just for one, but for all. I am here because we need to protect Fresno members, and make sure this 'cancer' of home care cuts doesn't spread. What happens to my brothers and sisters here happens to me. I believe by touching one person's life, you change many others'. It's called the 'butterfly effect,' which is the name of my team knocking on Fresno doors."

Glenda was volunteering in Riverdale yesterday, a farming-based community in Fresno County. "I would love for Schwarzenegger to visit here and witness this tight-knit family community, where workers are proud of their union. Schwarzenegger lives in an affluent place with affluent advisors. His decisions affect many people's lives."

Home care workers in Riverdale take care of the elderly and the vulnerable who would otherwise have to travel many miles to access medical care. Nineteen-year-old SEIU UHW voter Mercedes White said "we have to stick with our union. I love being a home care worker and am passionate about my job. I trust SEIU UHW and always liked the fact that we are family--looking out for each and every one of us."

Mercedes had her ballot on hand yesterday. "It's important to me that I mail it today. I want to be more involved with SEIU UHW!" she said.

SEIU UHW member Carrie Bonner, who has been a home care worker for 20 years, said, "I already voted for my union, SEIU UHW. This is the best thing for us. Nothing is going to change except that we get stronger--if we stick together." Member Ricardo Mojica is out of town but his mother Leticia Vega said, "My son already filled out the ballot and said it was important to him; and that we need to stay in SEIU UHW."

SEIU UHW Trustee Dave Regan praised the enormous effort put forth by the nearly 1,000 SEIU members and activists who came to Fresno. "I made one promise when we kicked off this drive on Monday. I said that we would win this election to protect Fresno County Home Care workers. We have delivered on that promise. The election is virtually over tonight."
Sergio Martinez, a Fresno home care worker who cares for his father said, "I already voted for SEIU UHW because I think this is the best union for us. We need a strong union and SEIU has been around for years--why change now for the unknown? My father was a farm worker with Cesar Chavez, and I'm a strong union supporter. I was raised in a union family, so SEIU UHW is my choice."

SEIU UHW members from Kaiser have helped lead the charge this week to protect Fresno home care members from cuts to their wages and hours, and to help them stick together in a strong union. Nearly 60 members who work at Kaiser facilities all over California turned out to meet with workers and help get ballots in the mail.

A couple of Kaiser members, Nancy Stengel, a medical assistant at Kaiser Irvine and Adoravida "Dory" Machica, a lab assistant at Kaiser Los Angeles Medical Center talked about the important job home care workers do.

"Home care workers are the forefront of caregivers," said Nancy Stengel. "They take care of our most important people - our families. Without them our loved ones do not stay at home with the quality of life that they deserve."

Nancy believes that home care workers deserve the same respect as their hospital or nursing home counterparts. "We are fighting for decent pay and to protect funding for our most important caregivers."

Dory Machica said, "I continue to knock on doors in Fresno to answer their questions and let our brothers and sisters know that we support the fight to keep what is theirs - the largest, strongest union in the state."

Manning the Doors While Others Knock

While most members are out knocking on doors and talking with Fresno County home care members, there are a number of SEIU members who are manning the doors and tables at the County Fairground to make sure things run smoothly and safely.

Robert Branch, a security officer and SEIU SOULA member, talked about his role in the Fresno GOTV effort, saying "I came to help SEIU UHW members stay with the union. I'm working security at the fairgrounds here so that the people inside the building are free to do their work without any outsiders coming in. It's my way to support the effort."

Terri Green, a fellow SEIU SOULA member currently manning the fairgrounds, talked about the day she spent meeting with workers on the doors. "I used to be a home care worker, taking care of my grandmother. But I didn't have a union. The first day here, I got a chance to knock on doors and talk to the Fresno home care members. It was really great to talk with them--worker to worker. It helps a lot that I used to do this work, and without a union, so I know what's at stake for people. I talked to a lot of people yesterday and helped them see how they need to stick together in SEIU UHW," she said.

"I met with a man who takes care of his father. He's only been doing it for a few weeks and is applying for the SEIU UHW-provided health insurance. He's definitely voting for SEIU UHW now, but when I got there he wasn't sure. Once we went through all the facts, though, he said he was voting to stay with us." Terri has been working side-by-side with Robert these past few days.

Whether at the fairgrounds manning the registration and hospitality tables, the doors, or out on the streets meeting with workers, all the SEIU members and activists who've come to Fresno this week are doing their part to help protect SEIU UHW Fresno home care members.

GLBT Community Works to Support SEIU UHW Members

Kevin Xiong, Executive Director of SOY (Shades of Yellow), a non-profit GLBT organization in the Twin Cities, volunteered his time to knock on doors in Fresno and connect with SEIU UHW members. "By going door-to-door, we are seeking to correct deliberate efforts to set the union off course and sap our strength to meet the struggles that only a large, experienced union like SEIU UHW can win. Home care workers in Fresno are passionate about their union and understand the need to stick together," he said.

Regarding the recent California Supreme Court decision upholding Proposition 8's same-sex marriage ban, Kevin said, "This is a civil rights issue and breaks up California, dividing people in two classes--those who can marry with benefits and those who cannot.

Bao Thao, who drove from San Diego to volunteer time and meet with SEIU UHW home care members, said "unions must keep supporting all peoples so we avoid such discrimination as Prop 8. SEIU has provided that support, and so I'm here to support these members."

"SEIU UHW continues to fight this upcoming vote to weaken our union," said Kevin.

Why We Are Here: SEIU Members Speak Out

That's why what we're doing is so important. They need the other side of the story. SEIU has always worked for members and workers no matter where they are."

"I'm here to help Fresno County home caregivers fight these pay cuts because if it happens here it'll happen in LA, too. If we don't stand together as one then we won't win. The cut backs will just get bigger and bigger, and become a wave that moves from one county to the next. I'm here to win."

--Michelle Manikis, home care member from SEIU ULTCW

"We're here to keep the union together as one. If we stand strong together we can fight the cuts but if the union is divided it will cause havoc for members and our clients."

In our 2006 round of bargaining, we began to see that the message and lit we were getting from UHW was not focused on bargaining as much as it was anti-SEIU. But at Doctor's we weren't interested in political squabbling between Oakland and DC, we wanted to improve members' lives. That's why we're out here today in support of Home Care members, we're defending our union. It's not Sal's union, its not even Andy Stern's union - it's ours. And the International is putting a lot of resources into this fight to defend our union so you know I've got to be here to help out. Especially since on the doors there's been a lot of confusion among members. Getting the information out to them has been the key to getting all the support I see among Home Care members in Fresno. I give them website links to all the information they need to be able to come to a decision for themselves."

--Darwin Duncan, SEIU UHW chief steward at Doctors Medical Center of Modesto

"It's important for me as a home care worker to be here. I know what it's like to do this work. To try and cut these people's wages, it's just not right. It's been an opportunity to do good, help out a community that is 'mine' because we're all home care workers."

--Chris Coronado, CUHW home care member from Hanford, Calif.

"When I heard about this election and the cuts, I wanted to get involved because I know what it's like to be a home care worker. Imperial Valley is really small and I also thought it would be good to meet with other workers and see how they work here in Fresno. But my #1 priority is to make sure the workers here don't lose their union."

Fresno, CA -Arguing that cuts planned to home care scheduled to go into effect on July 1st would result in irreparable harm if allowed to proceed, the Service Employees International Union (SEIU) today filed for a preliminary injunction in the U.S. District Court for the Northern District of California to prohibit Governor Arnold Schwarzenegger, other state officials, Fresno County, and Fresno County IHSS Public Authority from implementing a rate reduction for IHSS providers that is scheduled to become effective on July 1st.

Last week SEIU filed a class-action lawsuit in U.S. District Court, Northern District of California seeking to stop the State of California and Fresno County from slashing the wages of home care workers to near poverty levels, which will make it difficult for disabled and elderly individuals to find IHSS providers and force some into nursing homes. The suit, brought on behalf of individual consumers and SEIU, charges that the planned cuts put seniors and people with disabilities at risk and violate the American with Disabilities Act, the Rehabilitation Act, and federal Medicaid Law.

The suit names Fresno County and the Fresno County IHSS Public Authority, as well as Governor Arnold Schwarzenegger, John Wagner, Director of Social Services, and David Maxwell-Jolly, Director of Health Care Services. The Fresno Board of Supervisors plans on cutting the wages of Fresno county homecare workers.

According to the suit, the cuts:

Violate the ADA by discriminating against people with disabilities, who will be forced into institutions such as nursing homes because they were unable to find IHSS providers as a result of the wage cuts.

Violate Federal Medicaid Law because the state did not conduct an impact analysis prior to enacting the wage reduction. Prior to enacting a provider wage cut, states are required to assess the effect of the cut on access to and quality of care.

Violate Medicaid equal access and quality of care requirements because reduced wages will force providers to seek other employment and there won't be enough providers available to the IHSS population.

Violate the Federal Rehabilitation Act (RA) because it discriminates against people with disabilities, who, being unable to find IHSS providers as a result of the wage cut, will be forced into institutions such as nursing homes.

But on Tuesday, he got a call from his son that surprised him.

"I was out working my turf in Clovis and my son called to tell me that the union was out on our street at our neighbor's house. He's an SEIU kid, so he recognized the purple they had on. I thought OK so that's someone else's area," he said.

But then, he decided to help out in his own backyard and went directly to his neighbor, home care worker Mavis Crowson, to check it out.

"When I got there, I saw a big NUHW sign on her door. Mavis has been our neighbor for about 15 years so I went to talk to her," he continued.

"I told him I'd already voted for NUHW," Mavis said. "James was so surprised, but he took the time to talk with me and explain all the issues, the cuts and everything. I knew I didn't have the right information before. I had even prayed on it about an hour before that, when I was trying to vote. Then James showed up and I took that as a sign."

Since Mavis had already voted, they weren't sure what to do. But then Mavis went back into her house and got the ballot. "I told him that I knew what to do, and I tore up the ballot!" Mavis said happily. "I'm calling on June 5th to get another one so I can vote for SEIU UHW, the real purple. I remember that SEIU keeps its promises. We got our raises and our healthcare. SEIU started with us and this other group is just a bunch of disgruntled people trying to take over."

Kerman Home Care Workers Vote SEIU UHW

Stephanie Tanis has been a home care worker for 12 years. But today this SEIU ULTCW member from Long Beach is one of the 900 SEIU members and activists out talking to Fresno home care workers. While knocking on doors in Kerman (about 20 miles west of Fresno), Stephanie met with Gurinder "Gogi" Singh.

"The County only gave me 2 ½ hours a day to take care of my mother, even though the doctor says we need more," Gogi said. "Before this, I took care of my dad and I've been doing this since about 1996. It's really hard. But I need to take care of my mom."

Gogi was sitting outside his garage with a friend--another Fresno County home care worker. They talked with Stephanie about the possible cuts to their pay, and talked about cuts to everyone's hours. Gogi had his ballot with him in the garage and got it out. After talking with Stephanie he said, "I'm voting yes for my union because I need more hours, not less."

After Gogi marked and sealed his ballot, Stephanie walked with him to the corner mailbox and he mailed it. Before leaving, he asked to see Stephanie's list and told her which of the home care workers he knew. "I'll call them," he said. "I know other home care workers, and maybe I'll call them too."

"You know when I needed more hours like that, I had to fight so hard with the County, so I know what it's like," Stephanie said later. "With SEIU though, I feel like I'm in a family and we're all fighting together to protect our jobs and clients. We're not alone and it makes me feel better. I really want to help these people in Fresno. I'll do whatever I can for them."

Brenda Martin is another Kerman home care worker. She has a story that's been repeated many times in the past few days. She got the chance to have a good discussion with an SEIU UHW member on Monday. After hearing she heard the real facts about what was happening, Brenda took down the NUHW sign that was put in her window and said she was sticking with SEIU UHW.

Then NUHW outsiders learned that Brenda stands her ground when she knows she's right.

They came by on Tuesday and asked if SEIU had stolen the sign. Brenda's answer? She said "I'm going with purple SEIU. I gave it [the sign] back. SEIU UHW has been there for us in the past and they are the ones who are strong enough to help us now."

Brenda said she realized the other side was making empty promises when they claimed they would raise her pay to $16 per hour. "My dad always said I should be careful. If it sounds too good to be true, it probably is."

I'm With Purple!

SEIU UHW Fresno home care workers continue to show strong support as they meet with SEIU members from New York, Detroit, Ohio, and Ontario, Canada.

1199 UHE (New York) members Raimundo Valdes and Margarita Pillot were out early talking with members on Tuesday. In one of their first stops, they ran into Yolanda Mendez, a Fresno home care member who hurried out to talk with them. "You guys are purple, right? I'm with you. We've been with you guys a long time. I'm not changing," she said.

Margarita, who is also a home care worker, talked with Yolanda about why she is here. "I have good benefits and pay because of my SEIU 1199. I want that for all healthcare workers," she said. "It's good to see that workers know how important it is to stay together in a strong union."

Later on, Raimundo talked about why he took time off to come to Fresno. "We're very proud to be part of this. The next couple of days are key to protecting these workers from cutbacks and from losing their union!"

Fresno caregivers Paul Sayalath and Sylvia Valencia met with SEIU members Louise Leeworthy, a personal support worker with the Red Cross in Ontario, Canada and Tommie Smith, a home care worker from Detroit.

Paul Sayalath had just received his ballot in the mail when Louise and Tommie drove up. "I get my health insurance from my union; I'm sticking with SEIU UHW all the way. It makes sense to stick with a big union," he told them.

Sylvia Valencia had already mailed out her ballot, but Louise and Tommie took a few minutes to chat with Sylvia and her family. Sylvia said she's "A proud member of SEIU UHW. It's my union and I'm sticking with it." Her family members kidded around with her, spilling the beans--that Sylvia had marked her ballot as soon as she got it.

Why We Are Here: SEIU Members Speak Out

"SEIU UHW was the union that got Fresno home care members their first contract in 2000. Now it's time for a new contract and we want to support them so they can go further. NUHW cannot help these people. They don't have any members, any money, or any recognition. SEIU has members and power and we're putting the two together here in Fresno so that these home care workers can get what they need. The time for waiting is over."

--Pauline Grant-Clarke, nursing home member from SEIU FHU (Florida)

"I'm here to support California healthcare workers in their effort to defend their pay. I came from Michigan because we're all in one family and there's strength in numbers. Seeing the struggle that these home care workers are going through has helped me understand the bigger picture in our union."

Many members started receiving their ballots today, and SEIU UHW members like Nubia Brennan, a transcriber at Kaiser LAMC were out meeting with Fresno home care workers.

Nubia met with home care worker Maria Alvarez, who showed her the envelope and confirmed, "Yo voté hoy para SEIU UHW. Ayer no sabía cual era el verdadero, pero SEIU siempre ha sido mi unión. Le dije a mi hermana que tiene que votar también." ["Today I voted for SEIU UHW. Yesterday I wasn't sure which was the real deal, but SEIU has always been my union. I told my sister she better vote too."]

"There's a lot of responsibility on our shoulders today and tomorrow, but we'll go the extra mile to make sure we help these workers," Nubia said.

As part of this critical push, Los Angeles home care member Frederick Lee caught up today with Bobbi Banks, a Fresno home care worker who takes care of her husband. Bobbi said she's an enthusiastic supporter of SEIU because, "I worked in Las Vegas when I was in my 20s, and SEIU was strong then and strong now."

While Bobbi and Frederick talked about the union and the need for its strength, it became clear that the budget crisis--and the governor's plans to cut home care--is taking a toll on her. Tears welled up as she described the effect of the economy on her family. Pointing above her, she said, "We used to have the two bedroom apartment upstairs. But with the threatened cuts to my pay, and the cuts to my husband's Federal support--well we just couldn't afford it." The proposed cuts in Fresno County could cut home care worker pay by more than $1 an hour as early as July 1st.

She went on to say, "We can't afford to take chances on some union that doesn't have any members. Now Schwarzenegger is talking about even more cuts. We need a union with 2 million members. People are hurting, we don't need some organization that just has a few hotshots trying to divide us."

Joey Santana, an SEIU UHW member from Modesto met up with Fresno home care worker Kathi Ball and her consumer, Bobby Moulds to talk about the cuts today. "My primary concern isn't even so much about keeping a good job for me. I'm more concerned about what's going to happen to Bobby. He's tried a convalescent home before and it just did not work out. If the County keeps cutting back on services I don't know what's going to happen to him," Kathy said.

After they visited, Joey talked about his experiences at Modesto's Doctor's Medical Center where he works for a company called HHS. "When I started working for HHS we were getting a lot of fliers from UHW bad-mouthing SEIU. It didn't make any sense to me; I mean, we're all part of the same organization. It didn't seem like fighting amongst ourselves was going to be of any use to the members. That's why I'm sticking with the side that wants to keep the union members together--that's the only way we'll win." Joey is on the SEIU UHW bargaining team at Doctor's and just helped negotiate a great new contract.

A Voice for the Hmong Community

Fresno County has a large population of Hmong-speaking home care workers. To help keep this community strong within SEIU UHW and fight back against the budget cuts, a number of SEIU Hmong-speaking members and activists have come from other California cities and Minnesota to talk with home care workers on the doors.

Kham Mova is a junior at Winona State in Minnesota, and he volunteered his time to come and speak with members of his community about the real issues they face as home care workers. "I think it's important that people come together and protect what matters to them--especially keeping what they've won like health benefits. My grandmother was a home care worker and when she was sick later in life it was home care workers who took care of her. It means a lot to me to be here."

Kham was joined by Joseph Yang, also from Minnesota. He commented that, "In reaching out to home care workers I see they have a voice in SEIU UHW--this matters! It's a great experience talking to members who feel safe in their union."

SEIU UHW Vows to Block Governor's Assault on Home Care

In response to Governor Schwarzenegger's speech to the joint session of California legislators this morning--SEIU UHW trustee Eliseo Medina said, "The governor's proposed cuts to home care would add up to 340,000 people to the ranks of the unemployed, moving California's unemployment rate to 12.8 percent--nearly tied with Michigan for the highest in the nation. This is exactly the opposite of what California needs."

The governor's proposed cuts would:

Cost the state more than a BILLION DOLLARS a year in lost federal funds.

Possibly force 395,000 elderly or disabled Californians out of their homes as they lose home care services.

But SEIU UHW is fighting back with:

An aggressive statewide campaign to stop the cuts made by the Fresno Board of Supervisors and the legislature from going into effect.

A class-action lawsuit to stop the State of California and Fresno County from slashing the wages of home care workers.

A 48-hour vigil in Sacramento last week where hundreds of home care workers from across the state descended on the state capitol to meet with assembly members.

Watch new SEIU UHW member and upcoming leader Frank Valdez canvass for the first time with mentor May Santiago. In the process, he strengthens his commitment to support and fight alongside his fellow union members in their time of need.

Together, SEIU members and activists are Makin' It Happen in Fresno, protecting home care workers from cuts and from a rival organization trying to weaken and divide home care workers.

Jackie Lemieux, a nursing home CNA and SEIU Florida Healthcare member, met up with Fresno home care recipient Bertha Law. Ms. Law's grandson, who is an SEIU UHW member and supporter, is Ms. Law's home care provider.

"My grandson started taking care of me about 3 years ago. I was a cancer patient--throat cancer. But by some miracle, I'm now cancer free. I go to so many doctors' appointments, just about every day. My grandson takes me to them all. He also cooks and cleans the house, does the washing. He takes care of my oxygen and medications too," she said.

After their visit, Jackie talked about why she was so committed to the fight for affordable health care and to Fresno home care workers saying, "My mother died of cancer in 2005 and that's when I got active. I'm fighting to make sure people have the healthcare and medicines they need to be taken care of because my mother was denied what she needed. I'm in cancer recovery myself, and a few weeks ago I broke my ankle. I really shouldn't be doing all this walking, but I'm doing it anyway.

The Fresno workers' fight is my fight, so I came out to help. I'm here on a mission to help give Fresno home care workers the chance to stick together in SEIU UHW and defend themselves."

While her 3 year-old great grand daughter played in the living room, Ms. Law explained how her grandson told her he is voting to stay strong in SEIU UHW, and talked about what home care means to her.

The Long and Winding Road

SEIU members from throughout North America hit Fresno County streets in force Monday morning but, as we found out on the Obama campaign trail, we don't always reach our targets on the first visit. Sometimes no one is home and the road seems long.

"We don't let that bother us though. We know how important this is to our home care members in California. We'll find a way to reach them," said Alicia Treadwell, an SEIU home care member from Milwaukee.

Sometimes all you can do is leave the literature at the door when no one is home.

"But sometimes a worker's family members are home, and we get a chance to talk to them. Family often thank us for making the effort, and tell us they'll pass on the message. Of course, we're still going to come back when the member is home," assured Airenna Simmons, an SEIU home care member from Detroit.

And then sometimes you have to respect the snarl of that Rottweiller behind the door, and that's just what Debbie Scabilis, a public healthcare worker and SEIU member from Montreal, Canada did.

"Well, the dog made me nervous, but the woman at the door verified I had the right place. When I called the member on the phone, he said he was an SEIU UHW supporter and would be back at 3 this afternoon. You just have to stick with it. I'll reach all the members on my list," she said.

Why We are Here: SEIU Members Speak Out

Karl Arana, a social worker and SEIU 1021 member from the Bay area jumped at the chance to come and help Fresno home care members. "This is my first campaign. I'm excited to learn and talk to the members here about how they need to stay united. As a social worker, I know we need to protect services, and home care is a vital part of protecting our vulnerable people. I want to talk to other members in Fresno and help them stand up for their rights against the cuts--and to stay united in SEIU UHW."

Nhia Kao Vang, whose wife is an SEIU UHW home care member in Sacramento County, came to Fresno to devote time to reach out to the sizable Hmong-speaking population of SEIU UHW home care members. "I am here for two weeks in Fresno to protect members' rights to vote and to block any deceptions that might deprive them of that right," he says. When he speaks to our members about recent events leading to an upcoming vote between SEIU UHW and an unproven new organization, he says, "members confirm their allegiance to our union and reject how hey were mislead. I feel obligated to offer true facts about our struggle as home care workers that provide hope to our future."

They came from across Fresno County, California, the U.S., and Canada with one mission: to protect Fresno County home care. More than 900 SEIU members and activists rocked the house Sunday, May 31st at the Fresno County Fairgrounds, kicking-off a massive get out the vote effort to help Fresno County home care workers protect their jobs, pay, and union.

Participants pledged to help keep hope alive for 10,000 SEIU UHW Fresno County home care members. The workers are besieged by both a state budget catastrophe and an opportunistic effort to start a new union, NUHW, which is led by former UHW leaders who were removed from office in January for misuse of member funds.

Fresno home care worker Lisa Brown told the packed hall how important her work was to her and her son. "We have been facing these terrible budget cuts and pay cuts for too long. I begged the former UHW leaders to come to Fresno and help us stop them. They said that it was more important to fight against SEIU than to fight for us and the people we care for. Now they want us to join their new group? No way."

After hearing Lisa's story, SEIU UHW trustee Dave Regan made a promise. "This week we will put an end to the ones trying to divide workers!" he said. "Their empty promises have been exposed and, with your help, we will be done with them in just a few more days."

90 year-old Fresno County home care consumer and union activist Jessie Lopez De La Cruz urged everyone to stand strong for the SEIU UHW members who provide her care. Ms. Lopez De La Cruz was the very first United Farm Workers (UFW) organizer hired by Cesar Chavez for Fresno County.

Ms. Lopez De La Cruz had a special message when introducing SEIU UHW trustee Eliseo Medina. "The last time I was in these fairgrounds was 1973, when Cesar Chavez and hundreds and hundreds of farm workers were arrested in protests, and they put us in jail. I know the important work you do, and I support SEIU UHW!"

Why We're Here: SEIU Members Tell the Story

"I'm here for the folks we care for. We need a strong union. It would be a horror story if the others came in. They don't have any power or members they can mobilize if we need help." --Jackie Peppars, Fresno home care worker

"There are Hmong people all over the country. SEIU is a strong, powerful union all over the country too. When you have 2 million members fighting for you--and 700,000 in California alone, you know you have the strength that we need to fight these big problems." --Shoua Xiong, Sacramento home care worker

"The union members are suffering because of this. 10,000 members need protection. It was easy for me to come here to help." --Reyna Rundberg, Illinois nursing home worker

Hundreds of SEIU-UHW members from across California and around the U.S. have come to the Central Valley to stand with Fresno County home care workers as they fight to keep their union strong and protect their future.

On June 1st ballots will go out to 10,000 Fresno County home care workers, asking them to decide on their future union representation. Workers will voting on whether to stay in SEIU, the nation's largest home care union, or be represented by NUHW, a start-up organization led by the former leaders of UHW who were removed from office for misusing members' dues money in January. The County mandated the election after NUHW filed a petition to force the vote. At issue is who best can represent the workers in the current climate of budget cuts.

Last week, California seniors, people with disabilities, and their SEIU caregivers launched a statewide effort to fight back against Governor Schwarzenegger's sharp and deep budget cuts. In addition, SEIU filed a class action lawsuit seeking a preliminary injunction to stop the State of California and Fresno County from slashing the wages of home care workers to near poverty levels and from reducing the hours of care seniors and people with disabilities receive from going into effect. The suit--brought on behalf of individual consumers and SEIU--charges that the planned cuts put seniors and people with disabilities at risk and violate the American with Disabilities Act and Federal Medicaid Law.

On June 1st ballots will go out to 10,000 homecare workers that will determine the future of homecare workers in Fresno. Workers are voting on whether they want to stay in SEIU United Healthcare Workers-West or be represented by NUHW, a renegade organization led by the former leaders of UHW who were removed from office for misusing members' dues money. At issue for most workers is which organization has the political strength, resources, and organization on the ground to fight budget cuts that threaten to end home care services for hundreds of thousands of Californians and add more than 200,000 home care providers to California's 2+ million unemployed.

The Election and the Budget Cuts

Last September, four months before the trusteeship of UHW went into effect the Fresno Board of Supervisors voted to cut the wages of home care workers by $1.10 an hour. The former leaders of UHW failed to prevent the cuts from going into effect. In February, the California Legislature followed suit and voted to cut funding for home care.

The Trustees of SEIU UHW has launched an aggressive state-wide campaign to stop the cuts made by the Fresno Board of Supervisors and the legislature from going into effect.

SEIU UHW filed a class-action lawsuit - seeking a preliminary junction to stop the State of California and Fresno County from slashing the wages of homecare workers.

SEIU UHW held a 48 hour vigil in Sacramento - last week hundreds of homecare workers from across the state descended on the state capitol to meet with assembly members a call for an end to the draconian cuts and call for shared responsibility and a smarter, long-term solution to the state's budget crisis.

SEIU UHW television and print ad campaign -- featuring President Barack Obama and Alameda Country home care provider Pauline Beck calling for a federal solution to ends cuts that will devastate seniors, people with disabilities and the critical care providers they depend on to survive.

On Friday, Governor Schwarzenegger proposed deeper cuts to home care that would gut services for 9 out of 10 home care consumers, and throw more than 200,000 home care providers out of work, potentially raising unemployment in California from 11 percent to 13 percent.

231,000 clients will lose services entirely.

156,000 clients will have their hours cut by three-quarters, from an average of 108 hours per month to about 25 hours per month.

Cut home care worker wages to minimum wage of $8 an hour from $11.50 an hour in current budget.

Eliminate "domestic and related services" for 90% of home care clients and eliminate services entirely for more than half of clients.

Cuts cost more than 200,000 jobs statewide, perhaps more than 250,000.

The Election Process

The election is being supervised by California State Mediation/Conciliation service. Ballots were mailed to 10,000 Fresno home care workers asking them to choose who they would like to represent them. Ballots must be received by the California State Mediation/Conciliation service by June 15. The ballots will be counted on the 18th of June.

The GOTV Effort

More than six hundred SEIU members from around the country, including hundreds of members from SEIU UHW in California have come to Fresno to participate in the GOTV effort. Members are SEIU's greatest strength. SEIU has 2.1 million members throughout the United States and is the largest union representing home care workers in the country. SEIU members have come to the Central Valley to stand with Fresno County home care workers as they fight to keep their union strong and protect their future.

Who is NUHW?

The National Union of Health Care Workers is a start-up organization begun in January by former leaders of SEIU UHW who were removed from office for misusing union dues.

SEIU Files Class-action Lawsuit to Stop Cuts

Fresno, CA - Hundreds of homecare providers, their clients, and community supporters protested Governor Schwarzenegger's massive proposed cuts to homecare services at his Fresno office today.

Eliseo Medina, Executive Vice President for the Service Employees International Union (SEIU) and Trustee for SEIU-United Healthcare Workers-West (SEIU UHW), announced the filing of a class-action lawsuit on behalf of homecare clients who face being forced out of their homes and into nursing homes if previously approved wage cuts go forward on July 1.

The lawsuit, filed in U.S. District Court in the Northern District of California by SEIU UHW and other SEIU homecare locals, seeks a preliminary injunction to prevent the State and Fresno County from implementing the planned wage reductions, alleging that they violate federal laws designed to protect seniors and people with disabilities.

"My wife's homecare providers have told me that they will have to look for other work if the wages are cut," stated Carlos Martinez, a Fresno lawsuit plaintiff. "I'm very worried that I'll have to put her into a nursing home because I won't be able to find anyone to take care of her."

The Governor's current proposed budget cuts would slash the hours of care seniors and people with disabilities receive and could cut homecare worker wages 30 percent, to the minimum wage of $8 an hour, a sharper reduction than the deep cuts already passed by the California Legislature and Fresno County being challenged by the lawsuit. The cuts could force tens of thousands of people out of their homes and into nursing homes, which could cost the state as much as four times more than home care services.

The lawsuit names Governor Arnold Schwarzenegger, John Wagner, Director of Social Services, David Maxwell-Jolly, Director of Healthcare Services, John Chiang, State Controller, and Fresno County as defendants.
